Overview

MSA with host member experts in a two part presentation and Q&A on the following topics:

  • Hour one: Killer Subcontract Clauses in an Uncertain Time
    Lauren and Hugh will describe the contract provisions that contribute to a subcontractor's risk on a 
    project, explain how these contract provisions can affect a subcontractor's risk, and discuss best practices to mitigate risk created by these contract provisions. 

    The presentation will include discussion of force majeure, suspension and termination clauses, notice provisions, no damage for delay, contingent pay clauses, and others, highlighting specific examples related to COVID-19 and other recent events where applicable.   
     

  • Hour two: Managing Employees in Crisis, Dealing with Leave Requests and Accommodations  
    Employers are constantly dealing with every manner of employee crisis, including physical health issues, mental health concerns, family leave needs and everything else under the sun.

Martin will discuss how employers should respond to employee requests for leave in accordance with federal and state laws, such as the Minnesota Human Rights Act, Family Medical Leave Act, Americans with Disabilities Act, American Rescue Plan Act of 2021, and Minneapolis and Saint Paul Paid Sick Leave laws.

Hugh represents contractors, subcontractors and owners in construction disputes in federal and state court, and in arbitration.  He is experienced in bond and mechanics’ lien claims and in the drafting and negotiating of construction and design contracts.  He also advises participants in the construction industry in regulatory issues. Hugh was named to the Minnesota Super Lawyers’ Rising Stars list every year since 2014, and is the Vice Chair of the Minnesota State Bar Association’s Construction Law Section Council.  Hugh is also a Contributing Editor to the American Bar Association Construction Law Forum’s preeminent construction-related journal, the Construction Lawyer.
